In order to ensure the greater progress of the China International Import Expo, the General Administration of Customs (hereinafter referred to as the "GACC") has formulated the Customs Clearance Notice for the Fifth China International Import Expo of 2022 and the Facilitation Measures of the Customs for the Fifth China International Import Expo of 2022 (see appendices for details) on the basis of summarizing the customs clearance facilitation measures for the previous four sessions of the Expo, which are hereby issued.

The Announcement is hereby given.

Appendix I. Customs Clearance Notice for the Fifth China International Import Expo of 2022

The Customs of the People's Republic of China will provide comprehensive and high-quality services for the Fifth China International Import Expo of 2022 (hereinafter referred to as the "Expo") and supervise the inbound and outbound materials for the Expo in accordance with the Customs Law of the People's Republic of China, the Law of the People's Republic of China on Import and Export Commodities Inspection, the Law of the People's Republic of China on the Quarantine of Importing and Exporting Animals and Plants, the Frontier Health and Quarantine Law of the People's Republic of China, the Food Safety Law of the People's Republic of China, the Regulations of the People's Republic of China on Import and Export Duties, and other laws and regulations.

During the Expo, the Customs will dispatch personnel to the comprehensive service area of NECC (Shanghai) to provide the relevant consulting services.

For temporary inbound exhibits for the Expo, National Exhibition and Convention Center (Shanghai) Co., Ltd. (hereinafter referred to as "NECC (Shanghai)") shall provide tax guarantees to the Shanghai Customs. On the basis of the Letter of Certification of Inbound Materials for the Fifth China International Import Expo of 2022 (Appendix I) and the List of Inbound Materials for the Fifth China International Import Expo of 2022 (Appendix II) issued by NECC (Shanghai), overseas exhibitors or the home transportation service providers entrusted thereby are exempted from submitting tax guarantees on a case-by-case basis to the Customs.

I. Record-filing for the Expo
NECC (Shanghai) shall complete the record-filing of Expo information with the Customs in advance through the "Single Window" platform and handle customs procedures in the form of "one-off record-filing with related lists submitted in batches" to ensure the quick customs clearance of materials for the Expo upon their arrival at the ports.

II. Examination and Approval and Admission of Exhibits
Inbound animals and plants and their products, special articles, and other exhibits that require quarantine approval (see Appendix III for the list) shall not enter China until applications for the entry thereof, which shall be filed by exhibitors before the entry, have been approved by the Customs.
Exhibits shall comply with the requirements of the Materials Restricted for Inspection and Quarantine of the Fifth China International Import Expo of 2022 (Appendix IV, hereinafter referred to as the "Restricted List") and the Materials Prohibited for Inspection and Quarantine of the Fifth China International Import Expo of 2022 (Appendix V, hereinafter referred to as the "Prohibited List").

III. Declaration of Inbound Materials
Temporary inbound goods for the Expo are subject to integrated customs clearance. NECC (Shanghai) or the home transportation service providers entrusted thereby will handle the declaration procedures with the Shanghai Customs, and port Customs will carry out inspection and release. For materials for the Expo which enter China by other trade methods, overseas exhibitors or their agents shall go through customs formalities in accordance with the current provisions.
Temporary inbound goods for the Expo under the ATA Carnet shall be reviewed and the ATA Carnet shall be endorsed by the competent Customs. The re-export period is the same as the validity period of the ATA Carnet.

IV. Inspection and Release of Exhibits
Inbound exhibits for the Expo are subject to inspection, quarantine, and other procedures in accordance with the provisions. Exhibits that need to be inspected at the exhibition pavilion due to special circumstances can be transported to the exhibition pavilion for inspection after an application is filed by NECC (Shanghai) or home transportation service providers entrusted thereby and examined and approved by the Customs. NECC (Shanghai) shall provide, among others, necessary office space and inspection facilities. For exhibits that have been identified as normal upon inspection, the Customs undertaking the inspection shall handle the clearance procedures.

V. Regulation during the Exhibition
During the Expo, the Customs shall dispatch personnel to conduct on-site regulation in accordance with the law. NECC (Shanghai), home transportation service providers, and exhibitors shall abide by the administrative provisions of the Customs on the display and sale of exhibits and cooperate with the Customs in regard to regulatory efforts.

VI. Disposal of Exhibits
1. Consumption of exhibition materials.
NECC (Shanghai) shall urge exhibitors to inform the Shanghai Customs in writing of the expected consumption in advance, and explicitly specify the intended use (trial, tasting, or distribution) and quantity (which shall match the event size to a reasonable extent) of exhibition materials. The relevant exhibitors shall hold conformity certificates (official certificate of a participating country/test report of a third party/self-test report of the exhibitor/exhibitor's conformity declaration) for exhibition materials for intended trial, tasting, or distribution purposes.
The Customs shall verify the quantity and total value of inbound exhibition materials for the Expo in light of the actual situation, and exempt duties, import value-added tax, and consumption tax within a reasonable range in accordance with the relevant provisions:
(1) small samples (excluding alcoholic beverages, tobacco products, and fuels) for the exhibition, including food or beverage samples that are imported in original packaging or that are made from imported bulk raw materials. Such goods shall meet the following conditions:
A. they are provided by exhibitors gratuitously and exclusively distributed to the audience for use or consumption during the exhibition;
B. they are used as advertising samples and their unit price is low;
C. they are not applicable for commercial purposes and the unit volume is obviously less than that of the smallest corresponding retail package; and
D. the food or beverage samples have not been packaged or distributed subject to point C of this Paragraph, but they are actually consumed in the exhibition.
(2) materials that are consumed or damaged during operation and demonstration of machines or parts displayed.
(3) goods of low value that are consumed in the arrangement or decoration of temporary exhibition stands.
(4) relevant publicity materials that are gratuitously distributed to the audience during the exhibition.
(5) files, forms, and other documents to be used during the exhibition.
Where the quantity of any exhibition materials as listed in Sub-item (1) is in excess of the import limit, the excess shall be subject to duties and taxes in accordance with the law. Any exhibition materials as listed in Sub-items (2), (3), and (4) that have not been completely used or consumed shall be re-exported; otherwise, import procedures shall be handled in accordance with the provisions.
2. Retention for sale after the exhibition.
For exhibits retained for sale after the exhibition, NECC (Shanghai) or the home transportation service providers entrusted thereby shall handle import procedures on a unified basis in accordance with the relevant provisions of the Customs. Where the administration of permits is involved, the relevant permits shall be obtained.
Eligible inbound exhibits that are included in the List of Cross-border E-commerce Retail Imports are allowed to be sold in the same manner as bonded retail import commodities are traded on cross-border e-commerce platforms if they enter the special customs supervision areas or bonded logistics centers (Type B) (hereinafter referred to as the "regional centers") that are registered with the Customs after the end of the exhibition.
3. Re-export.
Temporary inbound exhibits for the Expo shall be re-exported out of China within the time limit specified by the Customs.
Temporary inbound exhibits for the Expo other than those under the ATA Carnet shall be verified and written off after the relevant procedures are handled with the Customs if they are transferred to special customs supervision areas and bonded supervision places after the end of the Expo (automobile exhibits shall be transferred to special customs supervision areas and bonded supervision places that can conduct the bonded warehousing of automobiles).
4. Extension of the re-export of exhibits.
Where any extension is indeed needed for the re-export of temporary inbound exhibits for the Expo, extension procedures shall be handled with the Shanghai Customs in accordance with the provisions.
5. Bonded display and transactions.
After an enterprise in a regional center submits a guarantee for the bonded goods, the goods can be transported to an exhibition pavilion of the Expo outside the regional centers for display and sale.

VII. Equipment of Reporters
With respect to the temporary inbound reporting equipment of foreign reporters, customs clearance procedures shall be handled with the Customs in accordance with the relevant provisions of Announcements of the General Administration of Customs [2008] No.104, [2009] No.19, and [2009] No.31.
For inbound and outbound materials for the Expo that fail to go through the customs formalities in accordance with the provisions, the Customs shall deal with them in accordance with the relevant laws and regulations.
Matters not covered herein shall be handled in accordance with the relevant laws and regulations.

Appendix II: Facilitation Measures of the Customs for the Fifth China International Import Expo of 2022

The Customs Clearance Notice for the Fifth China International Import Expo of 2022, the List of Materials Restricted for Inspection and Quarantine of the Fifth China International Import Expo of 2022, and the List of Materials Prohibited for Inspection and Quarantine of the Fifth China International Import Expo of 2022 have been formulated and are hereby promulgated to provide detailed guidelines for overseas exhibitors.

II. Setting up a Normalized Service Agency for Quick Response
The Shanghai Customs, subordinate to the NECC (Shanghai) Customs, is a normalized service agency of the Customs to serve the Expo. It shall do a good job in the customs regulatory efforts and service guarantee efforts for the Expo.

III. Deepening Technological Applications and Creating an Intelligent Regulatory Service Mode
Efforts shall be made to provide full-process regulatory services for the information on exhibitors and exhibits of the Expo through a cross-border trade management big data platform and information technology, and create a digital, intelligent, convenient, and intensive full-process regulatory service mode for the Expo.

IV. Dispatching Personnel to Provide On-site Service Guarantees
During the Expo, the Shanghai Customs will dispatch personnel to NECC (Shanghai) to provide customs clearance, regulation, consulting, and other services.

V. The Organizer Shall Provide Unified Tax Guarantees to Reduce the Burden on Overseas Exhibitors
For temporary inbound exhibits for the Expo, NECC (Shanghai) shall provide the Shanghai Customs with bank's letters of guarantee or tariff bonds for handling tax guarantees. On the basis of the Letter of Certification of Inbound Materials for the Fifth China International Import Expo of 2022 and the List of Inbound Materials for the Fifth China International Import Expo of 2022 issued by NECC (Shanghai), overseas exhibitors or the home transportation service providers entrusted thereby are exempted from submitting tax guarantees on a case-by-case basis to the Customs.

VI. Carrying out Inspection and Verification in the Nearest Locality to Further Facilitate Exhibition Participation
For inbound animals and plants and their products, food of animal and plant origin and Chinese medicinal materials, among others, that require administrative approval involving inspection and quarantine, the Shanghai Customs and related Customs are authorized to handle the approval procedures in the nearest locality, and the relevant approvals shall be completed within three working days; in accordance with the principles of "facilitation and operability", the Shanghai Customs is entrusted to exercise the power of acceptance and examination of overseas production enterprises of the imported aquatic products, dairy products, and cubilose sold in the exhibition area, which are exempted from overseas on-site examination. After the examination, the GACC will issue temporary registration documents, which can only be used during the exhibition and in the exhibition area.

VII. Setting up Special Channels to Prioritize Customs Procedures
VIP courtesy channels and special windows for customs declaration and special inspection channels of inbound exhibits shall be set up for the Expo at major ports to prioritize customs procedures such as declaration, inspection, sampling, and testing, to make sure that inbound exhibits will be released upon inspection.

VIII. Consolidating Regulatory Measures to Extend the Temporary Entry Period of Exhibits under the ATA Carnet
The regulation and service guarantee measures for the previous sessions of the Expo shall be consolidated. The re-export period of temporary inbound goods under the ATA Carnet endorsed by the Customs is the same as the validity period of the ATA Carnet.

IX. Advancing Admission Negotiations and Expanding the Types of Inbound Exhibits
Efforts shall be made to push ahead quarantine admission negotiations with participating countries or regions, expedite risk assessment progress, support acceptable agricultural and livestock products to participate in the exhibition and realize trade with China, and expand the types of inbound exhibits.

X. Simplifying the Regulatory Procedures to Facilitate the Entry of Special Articles
Special articles (biological products) carried by Expo participants for their own use which is limited to the prevention or treatment of diseases are permitted to enter China on the basis of doctor's prescriptions or the relevant certificates of hospitals. The permissible amount shall be subject to a course of treatment as determined by the prescriptions or instructions.

XI. Simplifying the Entry Procedures to Facilitate the Participation of Food and Cosmetics in the Exhibition
Prepackaged food and cosmetics for exhibition purposes only are exempted from being labeled in Chinese and sampling inspection, and the consignee or consignor record-filing certificates thereof are exempted from verification; where a small amount is offered for a try or taste, samples may be taken for inspection before the exhibition, and Chinese labels may be exempted, according to the food safety risk assessment; where a small amount is offered for sale on site in the exhibition, Chinese labels may be exempted.

XII. Simplifying the Exit Procedures to Facilitate the Post-exhibition Disposal of Exhibits
Temporary inbound exhibits for the Expo other than those under the ATA Carnet shall be verified and written off if they are transferred to special customs supervision areas and bonded supervision places after the end of the Expo (automobile exhibits shall be transferred to special customs supervision areas and bonded supervision places that can conduct the bonded warehousing of automobiles).

XIII. Supporting the Normalization of Bonded Display and Sale to Expand the Spillover Effects of the Exhibition
Special customs supervision areas or bonded logistics centers (Type B) (hereinafter referred to as the "regional centers") that are registered with the Customs may transport bonded goods to the bonded exhibition places of the Expo outside the regional centers for display, sale, and other business purposes after submitting guarantees for the goods.

XIV. Support Cross-border E-commerce Business to Promote Online and Offline Integration
Eligible inbound exhibits that are included in the List of Cross-border E-commerce Retail Imports (2022 Edition) are allowed to be sold in the same manner as bonded retail import commodities traded on cross-border e-commerce platforms if they enter the regional centers after the end of the exhibition.

XV. Support for the Participation of Cultural Relics Exhibits in the Exhibition and the Handling of Post-exhibition Retention for Sale Procedures
Exhibits that are identified by the state authority of cultural relics as cultural relics are allowed to participate in the exhibition as temporary inbound exhibits or in a bonded display manner. Where cultural relic exhibits that are allowed to be purchased by domestic consumers by the state authority of cultural relics are sold during the exhibition period, they may be imported without payment of tax, subject to the provisions of the tax preferential policies on import exhibits sold during the exhibition period of the China International Import Expo.

XVI. Prioritizing the Testing for Eligible Vehicle Exhibits and Issuing the Relevant Certificates
For vehicle exhibits that complete the individual vehicle certification, pass the China Compulsory Certification (CCC), and complete the disclosure of environmental protection information under the National Phase-VI Motor Vehicle Pollutant Emission Standards in accordance with the requirements of the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, the Customs shall give priority to the commodity inspection in accordance with the law and issue the relevant certificates such as the Goods Import Certificate and the On-board Inspection Sheet of Imported Motor Vehicles.
