Announcement of the General Administration of Customs [2022] No. 73- Announcement on Matters Concerning the Record-filing Management of Transport Enterprises and Their Ships Carrying Transit Goods by Domestic Waterways

Announcement of the General Administration of Customs [2022] No. 73

To further regulate the record-filing management of transport enterprises and their ships that carry transit goods by domestic waterways, the relevant matters are hereby announced as follows:

I. Transport enterprises and their ships shall apply to go through the record-filing formalities with the competent customs authorities directly under the General Administration of Customs (the "GAC") or with their directly authorized subordinate customs offices.

II. A transport enterprise that applies for record-filing shall meet the following conditions:
1. It has obtained registration as a market entity that is consistent with the business scope of the transport enterprise; and
2. It possesses the qualification for domestic waterway transport operations;
An application form for the record-filing of transport enterprises carrying transit goods by domestic waterways (See Appendix 1) shall be submitted to the competent customs authority at the time of handling record-filing of a transport enterprise.

III. A transport enterprise that has completed the record-filing formalities may handle the record-filing for the ship it owns or operates. The following documents shall be provided to the customs authority at the time of handling record-filing of the ship:
1. An application form for the record-filing of ships carrying transit goods by domestic waterways (see Appendix 2);
2. Relevant documents proving that the ship is owned or operated by the filed enterprise; and
3. A color photograph of the ship (required to be taken at 45° from the left side of the front and clearly show the name and the whole picture of the ship).
The filed ship carrying transit goods shall meet the customs supervision requirements and be equipped with navigation and positioning equipment.

IV. In case of any change to the record-filing information of a transport enterprise or its ship, the transport enterprise shall apply to the customs authority with which it has filed to go through the formalities for change of the record-filing information within one month from the date of the information change.

V. The validity period of the record-filing of a transport enterprise shall be consistent with that of the qualification for domestic waterway transport operations, and the record-filing of its ship shall remain effective within the validity period of the record-filing of the transport enterprise.

VI. The customs authority may cancel the record-filing of the enterprise and its ships according to law, under any of the following circumstances:
1. The enterprise applies for cancellation;
2. The enterprise has lost the registration as a market entity or the qualification for domestic waterway transport operations; or
3. Any other circumstances which result in cancellation as prescribed by laws and regulations.

VII. If a domestic shipping enterprise intends to carry out transportation of containers on the same ship for both domestic and foreign trade or coastal piggybacking business of ships on international voyages, it shall go through the record-filing formalities for the shipping enterprise and its ships with reference to the provisions of this Announcement.
Overseas shipping enterprises that have been approved by the Ministry of Transport to carry out coastal piggybacking business shall entrust their domestic agents to go through the record-filing formalities for shipping enterprises and their ships with reference to the provisions of this Announcement.
